Affiliate program terms
You apply, a person reviews it. We look for your own channel about music, audio or visuals, with a real and active audience.
These terms are an agreement between you (the "Affiliate") and Imaginando Lda ("we", "us"). To join, you submit an application and we decide whether to accept it. We may refuse any application without giving a reason.
We accept an application only when all of the following hold:
- 1.1Your own channel on our topic — music production, synthesizers, audio, DJing or audiovisual art — and most of what it publishes is about that.
- 1.2At least 1,000 subscribers or followers on your main channel, with views that agree with that number. A blog or magazine is judged on its content.
- 1.3Proof the channel is yours: we give you a short code to place in the channel description, bio or a page of your site until you are approved.
- 1.4Active: you have published something in the last three months.
- 1.5Not a coupon, deal, cashback or "review" site, a site that re-shares discount codes, or a marketing agency.
20% of what the customer pays, VAT excluded, on desktop sales you bring through your link or your own code, with or without a discount code. A visit from a paid ad earns nothing.
You earn 20% of the price the customer pays, net of VAT, on every qualifying sale. On a sale with no VAT (most sales outside the European Union) that is 20% of what the customer pays; inside the EU, the VAT comes off first. We may agree a different rate with you individually, in writing.
- 2.1Your code. A sale made with the discount code we issued to you is yours.
- 2.2Your link. Otherwise, a sale is yours when the customer clicked your referral link in the 30 days before paying. The first valid click counts: a later click on another affiliate's link does not replace yours, and yours does not replace theirs.
- 2.3Discount codes. A discount code on a sale your link brought does not cancel your commission, whoever issued it. The commission is calculated on what the customer actually paid, after the discount.
- 2.4Paid advertising. A sale whose click arrived through a paid advertisement — search, display, video, shopping or social — earns nothing.
- 2.5Your own purchases. A purchase you make through your own link or code earns nothing.
- 2.6Rent-to-own. Only the first payment of a rent-to-own plan, made in the cart, is a sale; the monthly instalments that follow are not.
- 2.7Desktop only. Purchases made in the App Store or Google Play are billed by those stores and are not part of the program.
Every commission is reviewed before it is approved. A sale that is refunded or charged back earns nothing, and one under dispute waits until the dispute is settled.
Quarterly, by PayPal or SEPA transfer, once you are owed at least €25. A sale refunded after you were paid for it comes off a later payment, for up to 12 months.
- 3.1Approved commissions are paid quarterly, in January, April, July and October, when your balance is at least €25. A smaller balance rolls over to the next quarter.
- 3.2We pay by PayPal or SEPA bank transfer, to the details you gave us. You are responsible for any fee charged for receiving the payment, and for any tax due on your commission.
- 3.3If a sale is refunded or charged back after its commission was paid, that commission is deducted from your next payments, for up to 12 months after it was paid.
- 3.4We may withhold, refuse or reclaim any commission, including one already paid, for a sale that results from a breach of these terms, including a breach discovered after payment. A reclaim may reach a commission paid up to 12 months earlier, and may be deducted from later payments.
- 3.5You can ask us for a statement of your sales and balance at any time.
Use your link as given, follow the law, and say honestly that it is an affiliate link. We may ask how you promote us.
- 4.1Use your referral link and code as we give them, so referrals can be tracked.
- 4.2Comply with every law that applies to your promotion, including disclosing that you earn a commission where the law or the platform requires it.
- 4.3Keep what you say about our products, prices and offers true and current.
- 4.4We may review how you promote us — your channels, campaigns, content and landing pages — and you will tell us where your traffic comes from when we reasonably ask.
No advertising on our name, no coupon tricks, no cookie stuffing, and nothing that looks like it comes from us.
- 5.1Bidding on, or using, our trademarks, trade names or product names — or any variation or misspelling of them — in any paid advertising, as a keyword, in ad copy, as a campaign name or otherwise.
- 5.2Publishing or distributing any discount code other than the one we issued to you, including codes issued to individual customers, codes from our own campaigns, and expired, invalid or invented codes.
- 5.3Describing a code or offer as "verified", "working", "exclusive" or with a usage count or success rate unless the claim is true and current, or advertising a discount we do not currently offer.
- 5.4Causing a referral to be recorded without the visitor's genuine and deliberate click on a link to our site — including cookie stuffing, hidden frames, images or redirects, pop-ups or pop-unders, automatic redirects, and "show code" or "reveal deal" buttons that open your link.
- 5.5Targeting people already in the middle of a purchase, including through browser extensions or software that inserts or replaces links or codes.
- 5.6Presenting yourself, an advertisement or a message as coming from Imaginando rather than from an independent affiliate, or registering domain names, social media handles or app listings that use our trademarks or confusingly similar names.
- 5.7Using our logos, product screenshots or marketing copy in your own advertising without our written permission.
- 5.8Promoting us on a site or platform that carries illegal, offensive or inappropriate content, or by spam or any fraudulent, misleading or deceptive means.
Either of us can end it at any time. Break sections 4 or 5 and we can end it at once, and unpaid commission is lost.
Either party may end this agreement at any time by telling the other in writing. We may end it immediately, without notice, if you breach section 4 or 5; we may also suspend your account while we look into a possible breach, and repeated sales through paid advertising lead to suspension.
When the agreement ends, you stop promoting us and remove your links, codes and any material that refers to Imaginando. Approved commission is paid in the next quarterly payment, whatever the amount; when the agreement ends because of a breach of these terms, commission not yet paid is forfeited.
We can change these terms and will tell you by email. Portuguese law applies, you are independent, and what you learn about us privately stays private.
- 7.1Changes. We may change these terms at any time. We will tell you by email, and the revision date at the top of this page says which version applies.
- 7.2Liability. We are not liable for any indirect, special or consequential damage, or for lost revenue, profit or data, arising from this agreement or the program.
- 7.3Independent contractor. You are an independent contractor. Nothing in this agreement makes you our partner, agent, employee or representative.
- 7.4Confidentiality. Information you receive through the program that is not public stays confidential, and you use it only for the program.
- 7.5Law. This agreement is governed by the laws of Portugal.
